We do not act as a shipping company and customs broker. Instead, we provide digital freight forwarding services of domestic and international freight services. We do not validate or otherwise authenticate, certify, confirm or endorse the customers of this Site, All direct communications, both verbal and written, are between the customer and fretigo india pvt. ltd. We have no control over and do not verify the accuracy of the information provided by customer.

No Liability

You agree not to hold Fretigo India Pvt. Ltd., its officer and owners, for any damage , claims or controversies (collectively , liabilities) that have arisen or may arise , whether know or unknown, related to your use of services. Including without limitation any liabilities arising in connection with the conduct, act or omission of any user (including without limitation stalking, harassment that is sexual or otherwise, acts of physical violence, and destruction of personal property), Under no circumstances will Fretigo India Pvt. Ltd. or its agent, vendor, partner, officers, or participants be liable for any direct, indirect, incidental, consequential, special or exemplary damages arising in connection with your use of or inability to use the services, even if advised of the possibility of the same.

Membership pattern

We offer our services to our members. By agreeing to the terms and conditions of this Agreement, you acknowledge that you can enter into legally binding contracts of this nature. We reserve the right to change our services and suspend, terminate or restrict your membership at any time, in accordance with the terms of this Agreement or our policies. If we change our services, or suspend or terminate your membership, you may be prevented from accessing our services either temporarily or permanently. If your membership is suspended or terminated, you are prohibited from applying for a new membership account with us. Your membership is not transferable. Your account (including feedback and any associated user identification) may not be dealt with in any way by any third parties. You must not allow third parties to use your account and you must not transfer or sell your account to a third party. As a member you are responsible for maintaining control of your account and for any activity that occurs on your account.

Indemnification

You hereby agree to indemnify, defend, and hold harmless Fretigo India Pvt. Ltd. & its owners, officers, employee, partners, service providers, subsidiaries, and affiliates from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred, arising from your use or inability to use the Services

Transaction

We provide the Site as a digital freight forawarding platform that allows members to communicate, request quotes, get offer, and purchase services. We reserve the right, entirely at our discretion, to refuse to provide a member with access to the Site. You acknowledge and agree that we are not involved in the actual transaction between yourself and the seller of the services, unless there is an express agreement to do so. We have no control over the adequacy and/or accuracy of the services for your use, safety and legality of the cargo to be shipped, and we have no control over the quality, safety or legality of items or content posted by members on to the Site, the truth or accuracy of listings, or the ability of suppliers to provide the services. We cannot ensure and do not guarantee that a member will actually complete a transaction or act lawfully in using the Site. When you enter into a transaction you create a legally binding contract with another member (third party). You are responsible for ensuring that you comply with your obligations to that member. If you do not comply with your obligations, you may become liable to that member. Likewise, if another member breaches an obligation to you, you are responsible for enforcing any rights that you may have against that member. Furthermore, you must ensure that you are aware of the relevant laws applicable to you in purchasing and/or selling the goods and services and providing the cargo to be shipped. Unless we advise otherwise on the Site, we do not offer any insurance or purchaser protection. We may make a record of all of your transactions.

Payments

Domestic and international credit cards issued by banks and financial institutions that are part of the Visa, Master Card & Amex Card networks;Net banking/Direct Debit payments from select banks, EMI option, cash on documents, credit terms. The User in using the third party statements, including bank and credit card statements, the merchant name may appear in an abbreviated format, and the Company has no control over the same. To successfully subscribe on the Website, the User is required to complete the transaction by making the payment for the services opted for.

Taxes

The User takes full responsibility for payment of all taxes and fees that are levied or arise in the course of use of the Website, including but not limited to downloading content and availing its service partner's service and all are subject to government taxes.

Fraud

We may, in our sole discretion, suspend or terminate your membership if we reasonably suspect or believe, or are informed by a government agency that you have engaged in or may engage in fraudulent or illegal activity using, or otherwise in connection with your use of our Site and you will have no claim whatsoever against us in respect of any suspension or termination of your membership under this clause.

Selling on site

You are solely responsible for the Information you provide and by using the Site, you agree that you will keep your Information up to date and information and/or contents posted by are in accordance with applicable laws. We may remove your information from the Site at our sole discretion. Cancellations

In any case if the services/shipment does not proceed after a quote is accepted on Fretigo India Pvt. Ltd..by the buyer, but before any services are performed by the seller, a cancellation fee is deemed to have occurred. In the event of a cancelation, the member may be contacted and requested to provide information which confirms the basis of the cancellation. This may include written confirmation of the cancelation signed by both the buyer and the seller, including reasons for the cancellation, identification of the party responsible for the cancellation, and comments. Cancelation of the service will entitle Fretigo India Pvt. Ltd.. at its discretion, to cancel membership. Failure to exercise this discretion and cancel membership after a cancelation does not prejudice Fretigo India Pvt. Ltd.. right to cancel a member's membership for a subsequent cancelation. Note: cancelation is not deemed to have occurred if shipment is delayed or rescheduled at a time suitable to both the buyer and the seller. Note: Excessive cancellations by a buyer or seller may impact their rating on Fretigo India Pvt. Ltd..

Insurance

We do not act as a Insurance company or agent. Instead, we provide an online marketplace for buyers and sellers of domestic and international freight services to meet, buy and sell cargo insurance services. In return, we take commission fee. cargo insurance are provided by third party member and we Fretigo India Pvt. Ltd. cannot ensure and do not guarantee that a member will actually complete a transaction or act lawfully in using the Site. For any claim, settlement or issue for cargo insurance of the shipments members (buyers & sellers) have to deal directly with themselves. You hereby agree not to hold Fretigo India Pvt. Ltd. & its owners, officers, subsidiaries, and affiliates from any claim, loss, expense or demand of liability, arising from your use of insurance services on this site.

Credit policy

Credit are subject to verification and approval from Fretigo India Pvt. Ltd. as per there terms & condition, and we Fretigo India Pvt. Ltd. cannot ensure and do not guarantee for credit facility, both the members buyers and seller has to comply with each other and communicate directly for any dispute and payment collection issue.You hereby agree not to hold Fretigo India Pvt. Ltd. & its owners, officers, subsidiaries, and affiliates from any claim, loss, expense or demand of liability by any law.

Dispute Resolution and Governing Law

In case of any dispute between the Users and other members on Fretigo India Pvt. Ltd., the parties agree to resolve the matter amicably vide arbitration under the Indian Arbitration & Conciliation Act, 1996. The venue of the arbitration shall be New Delhi, India. The language of the arbitration shall be English. Fretigo India Pvt. Ltd. may provide time to time certain promotional offers to customer. All promotions will be run at the sole discretion of Fretigo India Pvt. Ltd., and it can be activated, modified or removed at anytime by Fretigo India Pvt. Ltd. without advance notification. We do not warrant that transactions between members (Buyers & Sellers) will be free of disputes. You agree that if you have a dispute with one or more members of this Site, all disputes must be resolved between you and the relevant member(s). Under this Agreement, you acknowledge that if we are contacted by a member that claims to have a dispute with you regarding the provision of services, you agree hereby expressly that we can release your contact information to that member and/or any other authorities and person at our sole discretion in order for the dispute between you and the member to be resolved. You hereby irrevocably and unconditionally release us from all claims, demands and damages (actual and consequential) arising out of or connected with the dispute or our release of your contact information.

Security

Transactions on the Website are secure and protected. Any information entered by the User when transacting on the Website is encrypted to protect the User against unintentional disclosure to third parties. The User's credit and debit card information is not received, stored by or retained by the Company / Website in any manner.

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information.
